Know your HOA Homeowner Association Regulations and any Rental Restrictions

If your property is located in a gated community or is part of a condo hotel or villa complex it is likely to be subject to homeowner association rules. First off you need to check with your HOA homeowners agreement on any HOA restrictions, minimum rental regulations, and whether or not you need to submit an application to allow your property to be rented out. Note that if your community is non-deed restricted your HOA rules will have less influence over how and to whom you rent
your dwelling.

Popular rental restrictions are:

  • Property owners are required to own their home for more than 2 years before they can rent.
  • Condo associations can limit your rental term to twice annually.
  • Homeowner Associations can mandate rental minimums for a 90-day block
